Modifying a choice of law
The Regulation makes express provision for the modification or revocation of a choice of law that has been made. Article 22(4)[1] of the Regulation states the conditions for such a modification or revocation to be valid as to its form.
It is therefore necessary to refer to the laws that may govern the conditions of form that are applicable to dispositions of property upon death, as set out in Article 27[2] of the Regulation, to determine in what conditions such a modification or revocation is possible.
