What is the scope of the conflict regime by derogation?
The dispositions of property upon death above are subject to a particular treatment of conflicts insofar as the conflict principle set out in Article 21[1] of the Regulation must be disregarded. We must come to an agreement, however, on the scope of the setting aside of this conflict rule. It is the substantive admissibility and validity of the dispositions of property upon death and the binding effects between the parties to the agreements as to succession that are subject to a special conflict rules.
